Terms of Use

Please read these Terms carefully before using the Site www.oris.hr in order to buy products advertised on the Site or get information on a product.By using this Site and buying products from our Site you signify your consent to these Terms. You also represent that all information you provide will be true, accurate, current and complete. If you do not agree to the Terms, please do not use the Site. You can buy products of company Oris d.o.o. in the company’s office at the address Kralja Držislava 3, 10 000 Zagreb, Croatia or order the product by phone or email. 

Definitions and Interpretation

Seller: company Oris d.o.o., which owns the website www.oris.hr

Buyer: every person who decided to buy a product, registered their information and placed an order.

Online shopping: buying a product on the website www.oris.hr from the subpage Shop (Oris web shop).

Product: all items which can be ordered and bought from Oris web shop:  individual issues of Oris magazine, subscription to Oris magazine, other publications, tickets for Days of Oris.

General terms

Buyer must be an adult over 18 years of age who has business capability and complies with general terms of business or a legal entity that complies with general terms of business.

Sales contract between Buyer and Seller will be concluded when the product is ordered.

Seller is authorised to, without previous notice, change the contents of the Terms of Business, product range, prices, and other information related to the web shop, as well as other contents at www.oris.hr. Users of the website www.oris.hr have to review the contents whenever they visit the website.

Web shop order

Online shopping can be done only if Buyer is registered at www.oris.hr. Buyer will provide true, current and complete personal information in the website registration form.

Buyer chooses the wanted product by placing it in the shopping cart. If Buyer completes the purchase of an already sold item, Seller will contact Buyer in order to arrange further action (money refund, purchase of another item or delivery of the bought item when Seller gets it from their Supplier). Seller has no other responsibilities regarding the abovementioned matter. Product images are for illustrative purposes only.

The shopping cart has all products chosen by Buyer, the price of the product and delivery and total price (VAT included).

Price and Payment

All prices are stated in kunas (Croatian currency: HRK) and include VAT. Delivery is not included and is paid separately. Payment is made in kunas.

Seller is authorised to change prices without previous notice. Seller can also, without previous notice and in any time, give discount, special offers for a specific time period or for a specific product, group of products and/or all products. Regardless of the above mentioned, all ordered items will be delivered according to the prices which were valid when the order was being placed. 

Buyer can pay for the products:

·         By credit or debit cards: American Express, MasterCard, Maestro, Visa, Diners
·         Collect on delivery (COD)
·         Payment upon receipt of the proforma invoice (e-banking, general payment slip, credit transfer)

Payment is considered completed when the authorisation from the card issuer is obtained. If payment is made by a bank transfer, it is considered completed when the amount is paid to the Seller’s giro account. The payment should be made to the giro account in Privredna banka Zagreb, no. HR8623400091110616380.

Security statement

Oris web shop uses T-Com Pay Way system for authorization and payment. T-Com Pay Way applies most modern standards of data protection – Secure Socket Layer (SSL) protocol with a 128-bit encryption and a MD5 algorithm. ISO 8583 protocol ensures that the exchange of information between a T-Com system and authorisation centres of card issuers is done in a private network which is protected from unauthorised access by a double fire wall. 

Privacy statement

Seller commits to provide protection of Buyer’s personal data by collecting only basic information about Buyers/Users, necessary for carrying out their obligations, inform Buyers how their data will be used and regularly offer Buyers the opportunity to decide how their information will be used, including the possibility that they decide to have their name removed from the mailing list used for marketing. All user data are adequately protected and are available only to employees who need to use them for carrying out specific tasks. Privacy principles apply to all employees of company Oris d.o.o. and their business partners.

Delivery

Delivery of ordered products is made after payment is received to the giro account of Seller by a standard delivery method (Hrvatska pošta) or a HP express dispatch service which will deliver the Product to your address within 10 working days. We will try to deliver all ordered items in one shipping package. If it is not possible (e.g. items cannot be shipped in one package, they are fragile, are not available or are too big), we reserve the right to ship items in more than one package.

When Buyer receives the product, they have to inspect the product. In case of visible defects Buyer has the right to refuse the Product and ask for the delivery of an undamaged product.

Delivery expenses depend on the contents of the shipment and are specified for each order in the web shop shopping cart. Most economical delivery price is offered for both variants (standard delivery method and a HP express dispatch service). With previous notice, Buyer can personally take the ordered products at the address Kralja Držislava 3, 10 000 Zagreb, Croatia, if they chose this option while completing the order.

If we are not able to deliver some of the ordered products, we will contact you by phone or an email in order to arrange the delivery or cancel the order.

DELIVERY PRICE: Delivery is charged according to the price list of Hrvatska pošta d.d. available at website: http://www.posta.hr/pomo-i-informacije/pravilnici-i-cjenici.

Returns, refunds and replacements

All products are thoroughly inspected before shipping insuring the quality and adequacy of the packaging prior to being shipped. Buyer does not have to accept the product which is damaged in transport.

If, upon initial opening of the package, Buyer finds defects caused by mishandling, product malfunction or that the wrong product was delivered, they can return or replace the product within 7 days from accepting the shipment:

·         By post to the address of Seller
·         Personally, in the office of company Oris d.o.o. at the address Kralja Držislava 3, 10 000 Zagreb

Delivery expenses of the products which were rightfully returned (damaged or wrongly delivered) and the expenses of their replacement will be covered by Seller. If they are returned by post, it has to be emphasized that delivery expenses will be covered by Seller.

Expenses of the return due to any other reason (dissatisfaction, etc.) will be covered by Buyer. Buyer can return the product within 7 days from accepting the shipment.

In some cases, when ordered items cannot be delivered, Seller reserves the right to, with previous written notice, (email) and a written consent (email) of Buyer, deliver the item whose price and quality are similar to the ordered product. Same terms apply to replacement items. 

Very rarely, due to high demand, some items may not be delivered or may be delivered in smaller quantity (i.e. if items have been completely or partially sold out). In that situation, Buyer will be notified by email in order to approve that they will receive a part of their order.

For properly returned items according to the following abovementioned terms, Buyer has the right to a refund to the amount of the selling price of the returned items (no refund for delivery expenses):

·         By a cash remittance to your current or giro account (for payments upon delivery or by a pro forma invoice)
·         By cancelling the debit on the credit card (for payments by credit cards)

Conversion statement

All payments will be effected in Croatian currency (HRK). The charged amount on your credit card account is converted into your local currency according to the exchange rate of credit card associations.

Other provisions

Seller entitles Buyers to use all services at www.oris.hr for personal and non-commercial uses. It is forbidden to change the contents at www.oris.hr in any way, as well as copying, public display, etc. It is forbidden to use the contents from www.oris.hr on other websites without the written approval of company Oris d.o.o.

If the purchased product is protected by copyright or intellectual rights, Seller gives no additional rights to use or publish the product or parts of product.

Although Seller invests a lot of effort so the published information about the product is true, some information on a certain product may not be updated or accurate. In that case, Seller will notify the Buyer who placed the order and Buyer will have the right to cancel their order or change it. Product images are for illustrative purposes only.
